Acceptable Use Policy

This Acceptable Use Policy (“Policy”) sets the rules for how clients and visitors may use the services, communications tools, and technology operated by Elevate IV SF (“we,” “us,” or “our”), including any messaging, webchat, phone, or automation features provided through our website, HubSpot forms, OpenPhone, Moxie, or similar systems (collectively, the “Services”).

The examples below are not exhaustive. By using our Services, you agree to comply with this Policy and our Terms of Service (collectively, the “Agreement”). We may update this Policy at any time by posting a revised version on our website. Continued use of the Services after changes take effect means you accept the updated Policy.

1. General Requirements

All users must comply with applicable communications, privacy, and data-protection laws (including CAN-SPAM, TCPA, and HIPAA where applicable). You may use the Services only for lawful, legitimate business purposes and in accordance with industry guidelines for responsible messaging.

2. Consent and Opt-In

Before sending any message (SMS, MMS, email, chat, or voice call) to an individual, you must first obtain that person’s explicit consent.

  • Recordkeeping: Maintain verifiable records (form submission, timestamp, or written consent) showing when and how consent was given.

  • Timeliness: If you don’t message an individual within a reasonable period after they opt in, reconfirm consent before sending.

  • No purchased lists: Do not use or share contact lists obtained from third parties.

  • Individual consent only: Consent applies solely to the brand and purpose presented at opt-in.

Contact initiated by the individual

If a person contacts your published number or form first (e.g., texting for appointment availability), that inbound message serves as limited consent for that conversation only.

Existing client relationship

You may send transactional or informational messages (appointment reminders, confirmations, receipts, service updates) to existing clients who provided their contact details and have not opted out. Do not use this exception for marketing or promotional content.

Ongoing programs

For recurring or automated campaigns, include clear instructions for unsubscribing (“Reply STOP to opt out”) and honor all opt-outs immediately.

3. Identification

All messages must clearly identify your business as the sender, except when continuing an active one-to-one conversation.

4. Opt-Out

  • Include standard opt-out language such as “Reply STOP to unsubscribe.”

  • Once someone opts out, you may send one confirmation message but no further communications until new consent is obtained.

5. Prohibited Content

You may not use the Services to send, host, or promote material that is:

  • Unsolicited or “spam” communications.

  • Illegal, fraudulent, or harmful (e.g., phishing, pyramid schemes, deceptive financial products).

  • Related to controlled substances, gambling, hate speech, or sexually explicit material.

  • Infringing upon others’ intellectual property.

  • Harassing, defamatory, obscene, or otherwise offensive.

  • Intended to bypass filters or detection systems (e.g., obfuscated words or misleading links).

  • Containing viruses or malicious code.

6. Message Abuse and Identity

Do not use bots, falsify sender information, impersonate another person or business, or use multiple numbers/accounts to evade anti-spam or rate-limit protections.

7. Reasonable Use

Bulk messaging and automation features must remain within normal operational levels for legitimate business purposes. Unusually high or abusive traffic that disrupts service performance may result in suspension or termination.

8. Monitoring and Enforcement

We reserve the right to:

  • Monitor communications sent through our systems;

  • Suspend or terminate access for any violation of this Policy or our Terms of Service;

  • Report suspected illegal activity to law enforcement or regulators.

9. Reporting Violations

If you believe someone is violating this Policy, please contact us immediately so we can investigate.
